This Notice of Privacy Practices describes how Elemental IV Therapy, LLC may use and disclose your Protected Health Information (PHI) and how you can access this information. We are required by law to maintain the privacy of your PHI and to provide you with this notice.

  • Treatment: To provide, coordinate, and manage your IV therapy or injection services, including sharing information with our Medical Director (Dr. Ariel Grobman, MD), Clinical Director (Stephen Yun, MSN, APRN, FNP-C), and prescribing providers involved in your care.
  • Payment: To process payments, verify insurance if applicable, and manage billing.
  • Health Care Operations: For quality assurance, staff training, compliance reviews, and business planning necessary to operate our practice.
  • Required by Law: To comply with applicable federal, state, or local laws, including mandatory reporting obligations.
  • Public Health Activities: To authorized public health authorities for disease reporting or safety monitoring as required.
  • Emergency Situations: To notify emergency personnel if necessary to protect your health or safety.

Uses and Disclosures Requiring Your Authorization

We will obtain your written authorization before using or disclosing your PHI for any purpose not described above, including:

  • Marketing communications that constitute a sale of PHI
  • Most uses and disclosures of psychotherapy notes
  • Any sale of your PHI

Technology Platforms We Use

Your PHI may be stored or processed through the following HIPAA-compliant platforms, each operating under a Business Associate Agreement with Elemental IV Therapy:

  • Aesthetic Record — electronic health records, clinical charting, and online booking
  • Qualiphy — telehealth Good Faith Examinations conducted by licensed prescribers prior to treatment

Note: Our website (elementalivtherapy.com) and general marketing tools are separate from our clinical systems. Information submitted through website inquiry forms is not automatically treated as PHI unless you are an established patient receiving care.

Your Rights Regarding Your PHI

Right to Access

Request a copy of your health records in paper or electronic format. We may charge a reasonable fee.

Right to Amend

Request corrections to your PHI if you believe it is inaccurate or incomplete.

Right to Accounting

Request a list of disclosures of your PHI made for purposes other than treatment, payment, or operations.

Right to Restrict

Request restrictions on how we use or disclose your PHI. We are not required to agree to all requests.

Right to Confidential Communications

Request that we communicate with you in a specific way or at a specific location.

Right to a Paper Copy

Request a paper copy of this Notice at any time, even if you agreed to receive it electronically.

Our Obligations

We are required to maintain the privacy of your PHI, provide you with this Notice, and abide by its terms. We reserve the right to change our privacy practices and apply the new practices to all PHI we maintain. If we make a material change, we will update this Notice and post it on our website.

Complaints

If you believe your privacy rights have been violated, you may file a complaint with us or with the U.S. Department of Health and Human Services Office for Civil Rights. You will not be retaliated against for filing a complaint.

03 · Service Agreement

Terms of Service

These Terms of Service govern your use of the Elemental IV Therapy website and your engagement with our services. By accessing our website or booking an appointment, you agree to these terms.

Nature of Services

Elemental IV Therapy, LLC provides mobile concierge IV nutrient therapy and intramuscular injection services administered by licensed Registered Nurses in Florida. All services are performed under physician-approved protocols with clinical oversight from our Medical Director and Clinical Director.

Important: Our services are wellness-oriented and are not intended to diagnose, treat, cure, or prevent any disease or medical condition. IV therapy and IM injections are not a substitute for professional medical care. If you are experiencing a medical emergency, call 911.

Medical Screening Requirement

All new patients are required to complete a Good Faith Examination (GFE) with a licensed prescribing provider via our telehealth platform (Qualiphy) prior to receiving services. Clearance is not guaranteed and is determined at the sole discretion of the reviewing provider. We reserve the right to decline service to any individual for clinical or safety reasons.

Booking, Cancellations & Refunds

  • Appointments are confirmed upon booking through Aesthetic Record.
  • Cancellations made less than 24 hours before a scheduled appointment may be subject to a cancellation fee.
  • No-shows may be charged the full session fee.
  • Prepaid packages and session credits are non-refundable but are transferable within 12 months of purchase.
  • If a service cannot be completed due to clinical contraindications identified at the time of service, a partial or full credit may be applied at our discretion.

Service Area & Travel

We currently serve Aventura, Sunny Isles, Bal Harbour, Golden Beach, North Miami, Brickell, Hollywood, and Fort Lauderdale, Florida. Service availability outside these areas is at our discretion and may be subject to a travel fee.

Patient Responsibilities

  • Provide accurate and complete health history information during intake and at every appointment.
  • Disclose all medications, supplements, allergies, and relevant medical conditions.
  • Notify us immediately of any adverse reactions following a session.
  • Ensure a safe, accessible environment for the administering nurse to perform the service.

Limitation of Liability

To the fullest extent permitted by applicable law, Elemental IV Therapy, LLC and its staff shall not be liable for any indirect, incidental, or consequential damages arising from the use of our services or website. Our total liability for any claim shall not exceed the amount paid for the specific service giving rise to the claim.

We are not liable for adverse reactions that result from inaccurate or incomplete health information provided by the patient.

Intellectual Property

All content on this website — including text, branding, design, and formulation descriptions — is the property of Elemental IV Therapy, LLC and may not be copied, reproduced, or distributed without prior written consent.

Governing Law

These Terms are governed by the laws of the State of Florida. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts located in Miami-Dade County, Florida.

Changes to These Terms

We reserve the right to update these Terms at any time. Continued use of our website or services after changes are posted constitutes your acceptance of the revised Terms.
